Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of the DMRS Tech API and web services at dmrstech.com (the “Service”) and of any My Book Showroom license key you obtain. By registering for, purchasing, or using the Service, you agree to be bound by these Terms. They govern the relationship between you (the site owner or administrator) and DMRS Tech (“we,” “us,” or “our”).

The My Book Showroom plugin software (the “Plugin”) is separate from the Service. The Plugin’s source code is licensed to everyone under the GNU General Public License (see Section 2), and your use of that code is governed by the GPL, not by these Terms. You are free to install and use the Plugin without agreeing to these Terms; they become relevant only when you use the Service.

2. Plugin License

The Plugin source code is distributed under the GNU General Public License v2.0 or later (GPL-2.0-or-later), as required by the WordPress Plugin Directory. The GPL grants you the freedom to use, study, modify, and redistribute the Plugin code, on as many WordPress sites as you wish. Nothing in these Terms limits the rights the GPL grants you in the Plugin code.

What these Terms govern is separate from the Plugin code: your license key, your access to the DMRS Tech API and web services, and the DMRS Tech name and brand. The GPL does not grant a license key or access to the DMRS Tech API; those are provided solely under these Terms. A paid license key is personal to you and non-transferable, and entitles you to activate the Professional (PRO) or Publisher (PUB) features and API on one live, publicly accessible WordPress site per key.

Development and staging installations operated by the same license holder on the same domain are covered by a single key. A single license key may not be used to activate paid features on more than one live, publicly accessible WordPress site.

3. License Tiers

My Book Showroom is available in three tiers:

“Lifetime” means for as long as DMRS Tech commercially supports and distributes My Book Showroom, or for ten (10) years from your purchase date, whichever is longer. There are no recurring fees for PRO or PUB tiers.

DMRS Tech reserves the right to introduce new optional add-ons or future tiers at separate pricing. Existing purchases are not affected by the introduction of new tiers.

4. Payment and Billing

License keys are purchased through the DMRS Tech website at dmrstech.com. All prices are listed in US dollars unless otherwise stated at the time of purchase.

Payment is processed by a third-party payment processor (Stripe or PayPal). DMRS Tech does not store your payment card details. Your purchase is complete when a license key is delivered to your registered email address. If you do not receive a key within one hour of a successful payment, contact us at support@dmrstech.com.

Because PRO and PUB are one-time purchases, there are no automatic renewals, no subscriptions to manage, and no recurring charges of any kind.

5. Refund Policy

There is no subscription and no renewal charge, so there is nothing to cancel. If the Plugin is not working as described, please email support@dmrstech.com before requesting cancellation — we would much rather help you get it working than see you leave.

Nothing in this section limits any rights or remedies you may have under mandatory consumer-protection laws that cannot be waived by contract; where such law requires a remedy (for example, for a product that is faulty or not as described), that remedy continues to apply. See Section 12 regarding mandatory consumer protections in certain jurisdictions.

6. Acceptable Use

These restrictions apply to the DMRS Tech Service — your license key, the DMRS Tech API, and the dmrstech.com website. They do not limit any right the GPL grants you in the Plugin’s own source code. You agree not to:

• Use the Service to violate any applicable law, regulation, or third-party rights
• Share, resell, sublicense, or otherwise transfer your license key to any other person or entity
• Use a single license key to activate paid features on more than one live, publicly accessible WordPress site
• Reverse-engineer, probe, or attempt to extract credentials or proprietary elements of the DMRS Tech API or its server-side license-validation service (this does not restrict your GPL rights to study or modify the Plugin’s own source code)
• Bypass, circumvent, spoof, or interfere with the DMRS Tech API, its authentication, or its rate limiting, or use forged or invalid credentials to obtain paid features (you remain free, under the GPL, to modify your own copy of the Plugin code)
• Use the DMRS Tech API or Service to host, transmit, or distribute content that is illegal, defamatory, obscene, or that infringes any third-party intellectual-property rights
• Conduct automated scraping, load testing, or denial-of-service activity against the DMRS Tech API

7. Intellectual Property

DMRS Tech retains all intellectual property rights in the Plugin software (subject to the GPL as noted in Section 2), the DMRS Tech API, the dmrstech.com website, and all associated trademarks, logos, and branding. The name “My Book Showroom” and the DMRS Tech brand are not licensed to you under the GPL or these Terms.

Content you create using the Plugin — book entries, author profiles, cover images, reader reviews, and all other data stored in your WordPress database — is entirely your own. DMRS Tech makes no claim to any content you create or store using the Plugin.

8. Disclaimer of Warranties

THE PLUGIN AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DMRS TECH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

DMRS TECH DOES NOT WARRANT THAT THE PLUGIN WILL OPERATE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICE WILL BE CONTINUOUSLY AVAILABLE, OR THAT THE PLUGIN OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of implied warranties. If you are a consumer in such a jurisdiction, some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DMRS TECH OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLUGIN OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

DMRS TECH’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR YOUR LICENSE KEY IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR (B) FIFTY US DOLLARS ($50).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. If you are a consumer in such a jurisdiction, some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless DMRS Tech and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Plugin or the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party right, including intellectual property or privacy rights.

11. Termination

DMRS Tech may suspend or terminate your license key if you materially breach these Terms and fail to cure the breach within 14 days of written notice. Upon termination of a license key, you must cease using any features that require that key. You may continue using the Plugin on the FREE tier.

You may terminate your use of the Service at any time by deactivating and removing the Plugin from your WordPress site. Termination by you does not entitle you to a refund, except where a refund is required by mandatory law (see Sections 5 and 12).

Sections 7 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Governing Law) survive termination of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of Kentucky, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms shall be resolved exclusively in the state or federal courts located in Kentucky, and you consent to personal jurisdiction in those courts.

If you are a consumer resident in a jurisdiction whose laws provide mandatory consumer protections that cannot be waived by contract (including but not limited to EU member states, the United Kingdom, Australia, or Canada), those protections apply in addition to these Terms to the extent required by applicable law.

13. Changes to Terms

We may update these Terms when My Book Showroom adds new capabilities, changes its pricing model, or as otherwise required by law. We will note material changes in the plugin changelog and update the effective date at the top of this page.

Continuing to use the Plugin after material changes take effect constitutes your acceptance of the revised Terms. If you do not agree to a material change, you may discontinue use of the paid features at any time and continue using the Plugin on the FREE tier.
